I will assist you, the creditor, in filing a proof of claim during a debtors' bankruptcy proceeding in an attempt to preserve the funds you are owed. I will also defend any preference litigation commenced against you the creditor in which you may have been asked by the Bankruptcy Trustee to return money to the debtor's bankruptcy estate that was properly paid to you by the debtor just prior to its bankruptcy filing.
I will also file a Motion for Relief from Stay of the bankruptcy proceedings, giving creditors the right to continue repossession or whatever action they were currently engaged in regardless of when the bankruptcy was filed. This approach may allow a creditor to continue to seek repayment or protect its security though the debtor has filed for bankruptcy.
I will also counsel creditors as to their rights once they have been notified that a debtor has filed for bankruptcy with regard to fraudulent transfers, fraudulent conveyances and the commencement of adversary proceedings to determine the non-dischargeability of debts.
